PRIVACY POLICY AND CONSUMER HEALTH DATA NOTICE

FreeStar Fitness (“we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, and share your personal information when you visit our website (freestarfitness.com), use our gym facilities in Burien and Federal Way, or interact with our services.
Important for Washington Residents: This policy includes a dedicated Consumer Health Data Privacy Policy section pursuant to Washington’s My Health My Data Act (MHMDA).
1. Information We Collect
We collect information directly from you, automatically from your device, and from third-party service providers.
A. Information You Provide to Us
- Contact Information: Name, email address, phone number, and mailing address (e.g., when you fill out a Leadpages form for a pass, sign up for membership, or opt-in to text alerts).
- Account Information: Username, password, and profile details for your Wellness Living member portal.
- Payment Information: Credit card or bank account details for membership billing. We use a secure third-party payment processor (integrated via Wellness Living) and do not store full credit card numbers on our own local servers.
- Liability Waivers: Signed contracts including health declarations and liability releases.
- Communications: Content of emails, text messages, or forms you send to us.
B. Consumer Health Data (Washington State Specific)
Because we are a fitness facility, we collect data that is defined as “Consumer Health Data” under Washington law. This includes:
- Physical Health Status: Information about your fitness goals, weight, height, or injuries provided during personal training assessments or PAR-Q (Physical Activity Readiness Questionnaire) forms.
- Body Measurements: Data collected if you choose to use body composition analysis tools (e.g., InBody scans) to track your progress.
- Service Use & Access Data: Records of your gym visits (via Key Fob swipes), class attendance, and purchase history of health-related services.
C. Information Collected Automatically
- Video Surveillance (CCTV): We operate security cameras in common areas of our facilities for the safety and security of our members, staff, and property. Footage is stored securely and deleted automatically after a set period unless needed for an investigation.
- Cookies and Pixels: We use cookies and tracking pixels (via WordPress and Leadpages) to analyze website traffic and improve our marketing. This may include your IP address, browser type, and pages visited.
2. How We Use Your Information
We use your information to:
- Provide Services: Manage your membership, process payments via Wellness Living, and grant access to the gym via your Key Fob.
- Communicate: Send you transaction receipts, membership updates, or respond to your inquiries (e.g., replying to drew@freedomfitnessgym.com emails).
- Text Messaging & Automations: We use Scipio to send automated text messages for appointment reminders, membership alerts, and occasional marketing offers. You are always informed before we add you to these lists.
- Opt-Out: You can opt-out of text messages at any time by replying STOP to any message or by asking a staff member to remove you.
- Safety & Security: Monitor gym usage via CCTV and Key Fob logs to ensure safety and prevent fraud.
- Marketing & Photography: As agreed in your Liability Waiver, we may use photos or videos taken during classes or on the gym floor for social media and marketing purposes.
- Note: You have the right to ask us not to use a specific close-up photo of you.
- Data Retention: We retain member data for the duration of your membership plus 7 years for tax and legal liability purposes. Signed Liability Waivers are retained indefinitely for legal protection.
3. Sharing of Information
We do not sell your personal data or Consumer Health Data.
We strictly share data only as necessary to run our business:
- Service Providers: We share data with trusted companies that help us operate. Our primary processors include:
- Wellness Living: For membership management, billing, scheduling, and email marketing.
- Scipio: For automated text messaging and member communication.
- Leadpages & WordPress: For website hosting and collecting inquiries.
- Payment Processors: To securely handle financial transactions.
- SMS Privacy Assurance (Carrier Compliance):
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. - Legal Requirements: We may disclose info if required by law (e.g., a subpoena) or to protect the safety of our members.
4. Washington State Consumer Health Data Privacy Policy
This section applies specifically to “Consumer Health Data” as defined by the Washington My Health My Data Act (MHMDA).
Categories of Consumer Health Data Collected:
- Individual health conditions, treatment, diseases, or diagnoses (e.g., info disclosed to trainers).
- Bodily functions, vital signs, symptoms, or measurements (e.g., heart rate monitoring, body stats).
- Data that identifies a consumer seeking health care services (e.g., fitness classes, training).
Sources of Data:
We collect this data directly from you (the consumer).
Purposes for Collection and Use:
We collect this data solely to provide the fitness services you have requested (membership management, personal training, safety).
Sharing of Consumer Health Data:
We do not “share” Consumer Health Data (as defined by MHMDA to mean sharing for separate commercial purposes) without your distinct consent. We only disclose it to processors (specifically Wellness Living and Scipio) necessary to fulfill your membership contract and communication preferences.
Your Rights (Washington Residents):
Under the MHMDA, you have the right to:
- Confirm whether we are collecting, sharing, or selling your Consumer Health Data.
- Access your Consumer Health Data.
- Withdraw consent for our processing of your Consumer Health Data.
- Request deletion of your Consumer Health Data.
Right to Appeal:
If we deny your request to exercise your rights (e.g., refusing to delete data because we are legally required to keep it for tax purposes), you have the right to appeal our decision.

- If your appeal is denied, you may contact the Washington State Attorney General at www.atg.wa.gov/file-complaint.
Minors (Ages 13-17):
While a parent or guardian must sign the membership contract and liability waiver for members under 18, the teen member (the “Consumer”) retains privacy rights under Washington law regarding their specific health data. We do not grant 24/7 Key Fob access to minors.

5. Security
We implement reasonable security measures to protect your information. However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%.
6. Children (Under 13)
Our services are not intended for children under 13. We do not knowingly collect personal data from children under 13. If you believe we have collected data from a child under 13, please contact us immediately so we can delete it.
